Remote Tribe t/a Beatrice Caffrey Coaching is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

10. Assignment

Remote Tribe t/a Beatrice Caffrey Coaching shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

11. Entire Agreement

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Remote Tribe t/a Beatrice Caffrey Coaching and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

12. Governing Law & Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of EU, and you submit to the non-exclusive jurisdiction of the state and courts located in the EU for the resolution of any disputes.

13. Health Requirements

You will use the Remote Tribe t/a Beatrice Caffrey Coaching Services at your own risk.

Anytime you use the Remote Tribe t/a Beatrice Caffrey Coaching Services you must be in good health. If you have any known pre-existing illnesses or health conditions, please first consult a physician before you begin to use Remote Tribe t/a Beatrice Caffrey Coaching. This is particularly important if you suffer from any cardiovascular conditions, spinal and/or joint problems, or other health limitations that limit your athletic performance.

Please do not use Remote Tribe t/a Beatrice Caffrey Coaching if you experience considerable pain, general malaise, shortness of breath, nausea, or dizziness. In such cases please consult your physician before you begin or continue to use Remote Tribe t/a Beatrice Caffrey Coaching.

14. Registration process for Beatrice Caffrey Coaching APP

To use the Remote Tribe t/a Beatrice Caffrey Coaching APP, you must first register and open a user account. An invitation to download and open a user account will be emailed to you once once payment has been approved. When you register you will be asked to accept these General Terms and Conditions and our Data Privacy Policy.

How a user agreement will be concluded depends on how you first register and whether you sign up for any additional, paid services.

15. Correction of input in errors

If you want to purchase a subscription through your Remote Tribe t/a Beatrice Caffrey Coaching APP, you will pay for the service through Stripe and Trainerize. Please contact us at beatrice@beatricecaffrey.com if you want to correct any input errors.

16. Contract Terms

User agreement

The user agreement between you and Us that results when you open a user account will remain in effect for an indefinite term and will end when you delete the Remote Tribe t/a Beatrice Caffrey Coaching APP and terminate the user agreement.

You may cancel your user account at any time for any or no reason and thereby also terminate your user agreement in its entirety.

To do so, you must send Us an e-mail to beatrice@beatricecaffrey.com so that We can erase your user data. Please note that after your user account has been cancelled all content and workout performance data will or may be erased by Us and you will no longer have access to content you have already purchased.

If at the time you cancel your account you still have a valid subscription, any amount you may already have paid for the subscription will not be refunded – either in whole or in part.

We have the right to terminate the user agreement for any or no reason in text form with two weeks' prior notice, however not before the end of the minimum contract term or the end of the applicable renewal term of your subscription.

17. Subscriptions

Our subscriptions have different minimum contract terms. All subscriptions will be automatically renewed for the time period of the selected minimum contract term until either you or We terminate the subscription. You may however opt out of the automatic renewal of your subscription at any time by choosing the appropriate settings in the APP.

18. Beatrice Caffrey Coaching App Services

You may download and use the Beatrice Caffrey Coaching app free of charge. You will receive access to your to your available workouts as part of a paid subscription.

When you download and use the Beatrice Caffrey Coaching App, in particular through third-party networks or in other countries, you may incur transmission charges of your Internet service provider.

We strive to provide you with uninterrupted operation of the Beatrice Caffrey Coaching APP and to make those services available as continuously as possible. We advise you however that full or uninterrupted availability is technically impossible, and We make no warranty for uninterrupted operation or any particular availability.

Our applications are continuously updated and adjusted for your security and for the stability of our applications. As a result, system requirements may change. We assume no obligation to make available to you any application (such as the Beatrice Caffrey Coaching APP) that will be functional on your terminal device at all times, if functionality on your terminal device should be limited by technological changes.

We reserve the right to change our business model at any time and, for example, to provide any or all Beatrice Caffrey Coaching APP only in exchange for payment. You will then have the option to decide whether you wish to continue using the Beatrice Caffrey Coaching APP in exchange for payment or stop using the Beatrice Caffrey Coaching APP. Any such changes will have no effect on existing subscriptions until the end of the contract term.

Our understanding of human health and athletic performance is evolving on a continuous basis. This may affect how workouts are evaluated. Even though our workouts are based on current studies and findings, we make no guarantee that our workouts are in conformity with current research results or findings.

19. Prices

If you decide to purchase a subscription, the price that counts for you will be shown on the checkout page of your purchase or on the website.

We reserve the right to change prices at our sole discretion. Any price changes will however have no effect on subscriptions you have already purchased.

20. No warranty

We make no representations or warranties that by using the chosen Beatrice Caffrey Coaching service you will reach your workout goal or achieve any other results.

21. General provisions

When using Beatrice Caffrey Coaching you will be shown workout instructions (e.g., for certain exercises and workouts). You must follow those instructions at all times as otherwise there will be an injury and/or health risk.

If you use any tools or equipment for exercises, you are fully responsible for making sure that such tools and/or equipment work properly and are installed and/or set up properly.

You are obligated to heed our health notices in Section 13.
